架空請求、裁判所から督促に
簡易裁判所の支払督促制度を悪用した架空請求に関する相談が、各地の消費生活センターに寄せられている。請求に対する異議を申し立てずに放置していると“架空”の請求が“本物”の請求になる恐れがあり、法務省や国民生活センターは注意を呼びかけている。
これって簡易裁判所からの書類が来てびっくりして支払う、とかってのを当て込んでの悪用なのかねぇ。
確かに債権請求の正当性の立証って難しいと思うけど・・・こういうのがまかりとおっちゃうと裁判所が「なんとかとハサミは使いよう」の「なんとか」扱いなんだよね。
これっていざってときに出頭しなかった不正業者を法廷侮辱罪とかで見せしめ、とかやんないとだめなのかなぁ？
